U.S. Pub Chain Files Chapter 11 Amid Rising Debts

The pub chain filed for Chapter 11 in federal bankruptcy court this week, reporting a gap between incoming cash flow and obligations and asking the court to pause collection actions while it negotiates with lenders, landlords and suppliers.

The filing seeks standard debtor-in-possession relief to allow continued operations, including motions to freeze certain creditor claims and approval of cash management and payroll procedures. Company management intends to keep locations open and employees paid, subject to court approval of those motions.

The filing states: “a shortfall between incoming cash flows and obligations that has grown over recent quarters.” The company describes higher rent and supplier costs, increased interest on outstanding debt, and obligations from prior expansion as contributors to its liquidity strain, along with a slowdown in evening on-premise consumer spending.

Under Chapter 11, the chain will remain the debtor in possession and must present a plan of reorganization for court approval. The proposed plan will detail how the company intends to restructure debt, which may include negotiated reductions in principal, extended payment schedules or debt-for-equity arrangements. Creditors and landlords will be notified and may file claims or object to the plan.

Possible outcomes include a confirmed restructuring that preserves locations, a sale of the business or assets, or conversion to Chapter 7 if reorganization fails. Bankruptcy schedules listing assets, liabilities and the largest creditors will become public as the case proceeds. Management states it will work with creditors and the court to finalize a path forward.
