The filing states the incorrect transfer occurred during an automated or manual distribution process and went to a user account in error. Bithumb began litigation after direct requests to the recipient did not yield an immediate return of the funds.
In its court papers the company asks judges to require the recipient to return the bitcoin, to preserve any remaining balance tied to the transfer, and to recognize the payment as unintended so restitution can be ordered under civil law. Bithumb has not disclosed the recipient’s identity or the exact timing of the transfer.
Legal recovery of mistakenly transferred cryptocurrency can be complicated if the recipient has already moved or converted the coins. Tracing efforts can be hindered by the use of mixing services, transfers to overseas accounts, or conversion into fiat or other digital assets. If the coins remain at an address controlled by the recipient or at an exchange wallet, courts can order freezes or seek cooperation from those platforms.
